WHEREAS, buyer desires to purchase and Seller agrees to sell Buyer the dog described below, upon the terms and conditions stated in this agreement and no other terms or conditions stated or implied.
1. DESCRIPTION OF THE DOG:

2.SELLERS REPRESENTATIONS
The following representations and conditions apply to the sale of the dog mentioned above:
a. As of the date of this agreement, the dog is in good health and free of communicable diseases.
b. The Buyer has 72 hours to have the dog examined by a veterinarian and to personally inspect the dog (buyer must wait until after the 72hr period to transfer registration ownership into his/her name) Any claims must be made within this time period and will be verified by Sellers own veterinarian at buyers expense. Any and ALL claims made after said time will not be considered for a replacement.
c. Buyer is completely satisfied with and waives any and all claims regarding the dogs conformation, outward appearance and temperament (meaning the Buyer is entirely content with the dogs outward appearance and temperament. Color is NOT guaranteed to stay the same when the adult coat comes in.
d. Absolutely NO cash refunds will be given once possession of the puppies has been transferred, they have been picked up by new owners or transferred to airlines care. In the case of any life threatening genetic condition that will create a health problem diagnosed within the 72 hour time frame after taking possession of the pup, we will replace the puppy with another puppy of equal value that is or will come available.
e. The puppy must be returned to us along with ALL registration papers within 48hrs of the vet diagnosis, at NO expense to the seller with a signed document from 2 non-associated licensed Veterinarians (both agreeing to the problem), This is provided that the seller is notified of the problem within 24hr after the exam in which problem was diagnosed. ALL vet records must be provided to the seller so that said records can be reviewed by sellers vet prior to any replacement. If said dog or puppy is put down for any reason without notifying the seller prior and without diagnoses from 2 un-associated veterinarians, no replacement will be offered.
f. If buyer does not take the puppy to a licensed Veterinarian within 72hrs from date of purchase, the warranty is null and void.
g. The seller is NOT responsible for any vet bills inquired by the buyer. If no replacement puppy is available, you will be notified when a replacement puppy becomes available. NO CASH REFUNDS WILL BE GIVEN! We will not be responsible for illness or health problems which were diagnosed after the 72hr time period which includes any illness or issues with eyes, hips, joints, skin issues nor anything else diagnosed after 72 hours of taking possession of puppy.
3.CONSIDERATION
This dog, identified in Section 1, is being sold for the total sum of $. A deposit of $. was received. Balance is paid in full
4.STIPULATIONS
This dog has been sold as pet quality only and we make no guarantees as to the showing, breeding or temperament of this dog and it is being sold with: Limited Registration Unless Seller agrees to give breeding rights to the buyer. Once pup is placed with full akc registration, we will not refund the cost paid for full AKC should the dog later be found to not be of breeding quality or be diagnosed with any genetic condition causing dog to not be used for breeding, if diagnosed after the first 72 hours of taking possession. Full Reg.___for $. extra.
5.LIMITATIONS OF CONTRACT
This contract applies to the original dog only and is non-transferable to a second party. The dog described in this contract is not guaranteed to be fit for breeding nor to have a particular personality, temperament, or appearance.
6. MAINTENANCE
a. If for any reason Buyer is unable or unwilling to keep and care for the dog, Buyer agrees to return the dog to the possession of Seller or to inform Seller if an appropriate new home has been found for the dog. An appropriate home would be one that maintains the dog as a companion with appropriate exercise, diet, and health care, as laid out in this contract
b. If Buyer or Buyers successor or assignees should violate the foregoing terms and conditions, Buyer agrees to pay Seller as liquidated damages an amount equal to the original Purchase Price as well as any transportation costs to return the dog to Seller.
c. Should Seller/buyer find it necessary to enforce any portion or this contract entirely in a court of law or other legal venue, Buyer agrees to be responsible for any and all court costs and attorneys fees and court will be held in the county (Chattooga ) in which the puppy was purchased.
d. All pups will come with a microchip just in case the pup is lost or impounded for any reason
Buyer agrees to keep the breeder registered as secondary contact.
e. Buyer agrees to have the pup or dog spayed or neutered by the time to said dog or pup is 1 year of age (unless breeder and buyer have a prior agreement) Buyer agrees that he/she understands this contract fully.
